Terms of Service

1. Introduction

These terms govern your relationship with Golf Traders Hub and cover any transactions where we provide services to you. Under these terms:

• We are the service provider – Golf Traders Hub;
• You are the customer or user of our services.

2. Agreement

2.1 Composition

The agreement consists of these Terms of Service and any other specific terms applicable to the services you use.

2.2 Definitions

• Business day – any day other than Saturday, Sunday, or public holiday in the jurisdiction where we operate.
• Business hours – our normal working hours on business days.
• Day – a calendar day from midnight to midnight.
• Sign – a handwritten or electronic signature of an authorised representative of a party.
• We, us, or our – Golf Traders Hub.
• Writing – information in physical or electronic form agreed for use, excluding email.
• You, your – any person using our services, including buyers or sellers using Golf Traders Hub.

2.3 Interpretation

• Headings are for reference only.
• Lists introduced by “including”, “excludes”, etc., are not exhaustive.
• Undefined terms have their ordinary English meaning.
• References to laws include amendments or extensions.
• References to persons include natural and juristic persons.
• Days are calculated from the first day excluded to the last day included.
• All times are calculated using GMT +2.

2.4 Departure

These terms apply to all customers consistently. Any negotiated departure will be recorded in separate terms.

2.5 Conflict

Specific service terms override these Terms of Service if a conflict arises.

3. Duration

These terms start when you:

• Accept them explicitly (e.g., by checking a box or agreeing to terms);
• Use any service (e.g., accessing the website); or
• Exercise any rights granted under these terms.

They remain in effect until terminated.

4. Services

4.1 Right to Use

• Only during the agreement duration.
• Subject to these terms.
• On a non-exclusive and non-transferable basis.
• For specified purposes we communicate in writing.

4.2 Capacity and Authority

You warrant you are legally able to enter into this agreement. Individuals must be 18+, and those acting for businesses must have authority to bind the entity.

4.3 Basis

• Permission to monitor usage for security and stability.
• Records being undisputed evidence of services provided.

4.4 Access Conditions

• Provide accurate registration/account information.
• Protect login credentials.
• Avoid introducing malicious software.
• Be responsible for activity under your account.
• Have the necessary equipment/software to access services.
• Abide by the agreement and policies communicated in writing.

4.5 Availability

Services will be made available to the best of our ability, but we cannot guarantee uninterrupted access. Scheduled and emergency maintenance may occur.

4.6 Invitation to Do Business

Marketing is an invitation to transact. Agreements are concluded only when we accept your listing or transaction.

4.7 Monitoring and Records

We may monitor usage for security/stability. Our records are conclusive evidence of services provided.

4.8 Breach

We may suspend or cancel your rights if you breach the agreement.

5. Classifieds

Classifieds allow you to advertise products. Fees may apply depending on service use and category.

• You must accurately disclose your account type. Misrepresentation may result in suspension or termination.
• Listings must be complete, accurate, and in your possession.
• Listings are active for 30 days from publication. Expired listings are no longer shown to buyers.
• Listing damaged or unsafe golf carts and golf equipment is prohibited.
• Sellers must provide descriptions of damage and repair details for repaired items.
• Items replaced under warranty may not be listed or sold.
• Generic promotions, duplicate listings, counterfeit/illegal products, and improper parallel imports are prohibited.
• We may request proof of ownership or authenticity. Non-compliance may result in suspension or termination.
• Reviews should only relate to completed transactions. Irrelevant reviews may be removed.

6. TradeSafe

• We may act as a middleman between buyers and sellers for transactions.
• Terms of the sale are agreed between buyer and seller via TradeSafe.
• Verification information may be required, all processing complies with data protection laws.
• Contact info may be shared to facilitate communication.
• Buyers must pay the agreed amount plus fees within 24 hours.
• Sellers have 7 days to ship goods; delivery responsibility rests with the seller..
• Buyers have 48 hours to inspect goods. Lack of response constitutes acceptance.
• Payment minus fees will be made within 1 business day of buyer acceptance.
• Protection applies only if the entire transaction occurs through TradeSafe.
• Transactions may be cancelled if payment or shipping deadlines are missed.

7–23. Moderation, Data, IP, Fees, Warranties, Liability, and Regional Terms

• We may remove offensive content; spamming and multiple accounts are prohibited.
• You own your data; derived data is our property; subcontractors may process data under contract; international transfer allowed.
• Confidential information must be protected for 5 years post-termination.
• We and our licensors own all proprietary rights; limited licence granted to provide services.
• Non-solicitation applies for 12 months post-termination.
• Fees depend on services; payment is due as specified; refunds, interest, taxes, subscriptions as outlined.
• We warrant trained personnel, reasonable service efforts, and legal compliance.
• Services are provided "as is"; direct damages limited to fees paid; indirect damages excluded.
• Breach, termination, notices, assignment, dispute resolution, regional and global laws apply as specified.
